Get Started With the ROBS Process

 

To get started with the ROBS process, 

please sign our Statement of Understanding and complete our ROBS Plan Questionnaire and pay our fee of $3,995 (by check or wire transfer).

Please see steps below outlining the process.

Note: The one step that sometimes slows the process is the release of funds from the existing 401k/IRA custodian (bank, brokerage, insurance company etc.) To avoid delays, you can contact your custodian immediately and instruct them to start the process of liquidating your account. They will likely have paperwork for you to complete to begin that process.

Remember that those funds will ultimately be deposited into your new 401k plan account, which you will be setting up at the bank or brokerage of your choice.  The quickest and cleanest way to accomplish the rollover is by them sending you a check for your desired amount (it may or may not be the full account balance).  Once received, you will deposit that check into your new 401k plan account


 Steps in the ROBS Process

  1. You sign and return our Statement of Understanding and Plan Questionnaire, along with our fee.
  2. We establish a new C-Corp, draft all corporate documents,  and file articles with the sec'y of state.
  3. We secure tax EIN #'s for your new corporation and for your new 401k plan.
  4. We design and draft a new 401k plan, which you adopt. This plan includes specific language that allows for the purchase of private corporate stock.
  5. We purchase an ERISA bond to protect participants from losses due to fraud.
  6. You set up your 401k bank or brokerage account for holding your retirement funds and your business bank account for holding the corporation funds.
  7. Funds are rolled over from your existing plan custodian into your new 401k plan account. This will occur by direct plan to plan wire transfer or by check. 
  8. The new trust plan then buys stock in the corporation with the "rollover" funds.  Funds are transferred from the new plan account into the corp bank account and stock certificates are issued to the plan with appropriate valuation. The plan now owns the corporation.
  9. Funds are now available in your business bank account to finance your business .
